Caught in the Crossfire: China’s New Supply Chain Security and Countermeasures Rules
Understanding Decrees 834 and 85 and what they mean for Danish companies operating in or sourcing from China
Clarifications and advice for Danish companies operating in and importing from China
For many Danish companies, doing business with China includes navigating challenges related to Chinese legal frameworks and regulations. As the US and the EU expand sanctions and export controls, Beijing is expanding its countermeasures regime and security related regulations – and companies that operate in or source from China now risk being “caught in the middle” between the regulatory demands.
China’s two new supply chain security regulations, issued this spring by the State Council, are the latest and most concrete expression of this: Decree 834 (The Provisions on Industrial and Supply Chain Security) and Decree 835 (The Provisions on Countering Improper Extraterritorial Jurisdiction). The first tightens China’s requirements around industrial and supply chain security; the second gives Beijing new tools to counter foreign sanctions and export controls that reach into Chinese territory, potentially leaving companies to decide which rules to follow.
These new regulations can potentially affect Danish companies that operate in, or import from China. DI therefore invites you to a webinar providing an overview of the regulations, discussion of potential implications and general advice for risk reduction.
We will discuss the following topics:
- What the regulations actually contain
- Case examples illustrating relevant Chinese legal practice
- General advice on how to minimize risks
Note: This webinar will cover both Decrees and broad implications across the areas of supply chain due diligence, sanctions implementation and de-risking. There will be a separate webinar only focused on supply chain due diligence later.
